Why are we asking you to make a choice?
As of season 2025, if you act as a tour operator to your clients, your company is legally liable to your clients. This means that you conclude the travel contract with your customers against your own general terms and conditions. In case of complaints, you are then the first point of contact for your customers. In this case, Boat Bike Tours is your service provider. Since you offer a package tour to your customers, in compliance with EU law, your company is responsible for providing legal insolvency protection to your customers.
If you choose to act as an intermediary when booking Boat Bike Tours trips from season 2025, you are (in a legal sense) offering Boat Bike Tours’ package tour to your customers. In this case Boat Bike Tours is in a legal sense the tour operator liable to the customer. Therefore, as an intermediary you are obliged to use the General Terms and Conditions of Boat Bike Tours, but you can also use Boat Bike Tours’ legal insolvency protection coverage. There are no costs involved for you as an intermediary.
Our company is based in Amsterdam, the Netherlands, and is therefore participant in the “Stichting Garantiefonds Reisgelden”, short: SGR (see also https://www.sgr.nl/english/ or https://www.sgr.nl/).
As an intermediary you will receive with the booking confirmations the SGR Guarantee certificate of Boat Bike Tours, which you can hand over to the customer.
In the Netherlands it is mandatory that (in addition to the contribution by the travel industry) every traveler (regardless of the amount of the travel price) pays a fixed own contribution of € 5.00 per person when booking a package tour. Moreover, we are obliged to mention the SGR contribution separately on the booking confirmation because we have to remit that € 5.00 per person to SGR.
This contribution of € 5.00 per booked guest therefore will appear on our booking confirmation to you as the intermediary and you must pass this amount on to the customer, but you thus save the own costs of the legal insolvency protection applicable in your country.
Your choice is also important because we want to make our BBT Partner Portal for registered partners bookable by mid-2024. This requires that all necessary variables of each booking partner are already set up in our system, such as the status “tour operator” or “intermediary”. This is another reason why your (quick) choice is important. We will of course keep you informed about the more precise developments regarding the new features of our Partner Portal.
Of course, your choice for “tour operator” or “intermediary” status does not change our commitment and services at all and we will continue to do our utmost to offer our mutual guests an unforgettable journey!
